2. By accessing and displaying this website, you implicitly and unconditionally accept the following provisions. In this regard, we recommend that you read these Terms and Conditions carefully.

OTI GENERAL TRADING SRL reserves the right to amend and add new provisions without prior notice.

3. The information presented on this website does not represent a binding offer, unless you place an order and receive an email confirming the order.

4. The otishop.eu website and its entire content, i.e. images, texts, logos, web graphics, scripts, programs and other data, belong to OTI GENERAL TRADING SRL and include information protected by the copyright legislation. References to materials, equipment and private information belonging to other companies may only be used with the express approval of all parties involved.

5. OTI GENERAL TRADING SRL manages this website mainly for e-commerce purposes, but also to inform you and keep in contact with you. You may download information from this website, but only for non-commercial purposes and only to use it for your personal purposes. Transmitting, modifying, reusing, publishing, reporting or otherwise using this information for public or commercial purposes without the written consent of OTI GENERAL TRADING SRL or its partners is strictly prohibited.

6. The information included on this website may contain technical inaccuracies or typos. OTI GENERAL TRADING SRL and its partners assure you that in case the price or some features of a product have been wrongly entered in our databases, all necessary measures will be taken to inform you and, if you wish, you may cancel the order.

Customer Support

1. Registering and creating your account

The Customer is any legal entity or natural person over the age of 18 who has all legal rights to validate an order. By selecting the "Pay for your order" icon, the Customer acknowledges and warrants that he/ she has full legal rights to accept the Terms and Conditions.

Before placing his/ her first order and customizing his /her own virtual space, the Customer must choose a name and a password consisting of at least 6 alphanumeric characters and at least one digit (a check to ensure one time registration will be carried out by our system). In case you lose or forget your password, it can be regenerated by clicking on the link "Have you forgotten the password?" and entering your email address. Then a new password will be sent to you by email. The password is strictly confidential and will be requested whenever the Customer will place an online order, being solely responsible for its use. Important! The password will not be used to make online payments, it will only be used for the purpose of registering the Customer to place online orders.

In order to make purchases on the otishop.eu website, the Customer must first create a customer account:

a) before making any purchases, by clicking on the “Create account” button, or

b) when adding the first product to the shopping cart.

In order to be able to create his/ her account, the Customer must add his / her name, surname, email address and a password. These 4 items are confidential. The customer will be solely responsible for the consequences of using his / her account until it is deactivated. Also, to create a customer account there is another quick way to create a customer account using an already existing Google account.

The Customer will also be asked for other personal information, such as: name, telephone number, accurate and correct delivery and billing addresses, post code. The Customer undertakes to provide accurate information and to update it in his account whenever a change occurs. This information is necessary for the management of the orders and commercial relations between otishop.eu and the Customer.

otishop.eu cannot be held responsible for erroneously entered information which may lead to delivery delays or other issues. In this context, all shipping charges applied for re-dispatching the order shall be borne by the Customer.

The history of the transactions between otishop.eu and the Client can be viewed at any time on the website in the "Account" section, where the most recent orders placed are displayed.

2. Subscribing to and unsubscribing from the newsletter

Subscribing to and unsubscribing from the newsletter of the otishop.eu website is free and optional and it implies acceptance of the following Terms of use. Messages we send are not unsolicited and you can always unsubscribe by following the instructions in the footer of each email. The messages we send comply with the e-commerce legislation in terms of commercial communication, as stipulated by the Romanian and international legislation.

The use of our newsletter shall fall under the same limited liability conditions in relation to its content as the use of our website, under the terms established in this document, and our Privacy Policy is comprehensively described in the next section.

OTI GENERAL TRADING SRL holds all rights over the content of the newsletter sent to its subscribers under the same conditions as for the information published on our website, in accordance with the provisions of this document.

The subscribers to the otishop.eu newsletter may forward these commercial communications to other persons, under their own responsibility and provided that they do not change the structure or the content of the respective messages. The persons receiving such commercial communications from the subscribers of the otishop.eu newsletter shall be deemed to have been informed in advance by the subscribers on the provisions of this article. In this context, OTI GENERAL TRADING SRL cannot be held liable under any circumstances for the actions of its subscribers.

OTI GENERAL TRADING SRL reserves the right to restrict the access of any subscriber to its newsletter, if it has reasons to believe that the subscriber does not comply with the provisions of this document.

3. Product characteristics

The products marketed on otishop.eu will be accompanied by a detailed description, allowing the Customer to take note of essential information before placing a final/definitive order.

By placing an order, the Customer acknowledges that he/she has taken note of all the data displayed on the website about the ordered products (name, price, weight, quantity, special product information, etc.) and that he/she accepts it without any reservation.

The detailed product information sheet is not a contractual base, it instead is there for information purposes only. We strive to provide accurate information about each product on sale on the otishop.eu website, so that we do not encounter unpleasant situations.

4. Availability of products and validity of offers

Product offers and prices displayed by otishop.eu remain valid as long as they are visible on the website and as long as available. Valid products and offers will be flagged on the website by the "Add to cart" button next to them. The mere fact of adding products to your cart does not mean the automatic validation of your order, as from the moment a product gets added to the cart up until the Customer validates order, the product (s) may become unavailable.

In order to avoid situations similar to the one above, otishop.eu will endeavour to ensure the availability of the ranges of products and services offered.

5. Unit Price

The prices of the products and services on the website are in Romanian lei (RON) and have all taxes included, except for shipment fees. Prices are applied at the time of validation of the order by the Customer. The prices displayed include VAT, and any legal changes regarding the value of this tax will be reflected in the price of the products and services on the website at the time of entry into force of the respective regulation.

If the price of a product or some features thereof have been incorrectly recorded on otishop.eu databases or incorrectly displayed, and the delivery has not been made, it reserves the right to cancel the delivery of the product and to notify the Customer as soon as possible about the error.

Shipping Options

Dear Customer,

Now it is easier than ever to choose Oti Shop products!

Each order placed from Monday to Friday before 12:00 will be handed over to the courier on that same day, with a delivery estimated for the next working day. For example, if you placed an order on Monday at 10:30, you would receive your items on Tuesday, and if you placed an order at 12:30, it would be picked up by the courier on Tuesday and delivered on Wednesday (this example is valid for weekdays).

1. Delivery Charges
We provide direct delivery to the address you provide to us. The ordered products will be delivered via the FAN Courier network. The delivery fee is calculated according to the destination and the weight of the package and it is automatically displayed in your shopping cart before you finalize your order.

2. Delivery Times
Usually, the delivery of the products purchased on our otishop.eu online store takes between 1 and 2 working days from the time of order confirmation, and it is made between the hours you select when you place the order. If there are exceptions to this rule, you will be notified immediately by email and asked to accept the respective delivery time.

NOTE: Check your packages at the time of their delivery, as any subsequent complaint that the package has arrived damaged shall be disregarded!

DISCLAIMER: FAN Courier has its own schedule and organization, which are independent of the seller's, and they are not impacted by our company's program. Any delays that may occur in the delivery process are strictly the responsibility of the shipping company. FAN Courier deliveries are carried out according to the standards and procedures specifically implemented and used by this company. We are not responsible for delays or errors caused by this company. Fan Courier has agencies in all counties of Romania, which each shipment in that specific area will pass through. Localities that are remote to the territorial agency may suffer delays in their delivery.

Payment Options

Otishop.eu customers can pay for their purchased products using the following payment methods: online payment by debit card or cash or card payment on delivery.

Online payment by debit card

Customers can pay for their ordered products when placing the order by selecting the online payment by debit card. Visa, Mastercard, American Express and UnionPay cards are accepted for online payments. Debit card information will not be stored on otishop.eu servers.

Cash or card payment on delivery

Customers can also opt for full card or cash payment at the time of delivery of their ordered products.

Rules on the use of the Oti Virtual Gift Card:

● It may be between 50 and 500 lei.
● It can be used to purchase any product offered by Oti Shop.
● It will be emailed within 24 hours of payment of the order.
● It can be used immediately once it is issued.
● It can only be purchased alone in the shopping cart, without other Oti products included in the same order.
● It can be used within the monetary limit it amounts to.
● The card cannot be topped-up.
● It cannot be used with another Oti Gift Card for the same order. It can be used with a shopping voucher, on the same order.

The Return Policies and Warranty

Rules on our free return service

A purchase can be cancelled and it is a free service offered to the customers of Oti General Trading S.R.L., a limited liability company, established in compliance with the Romanian legislation, with its registered address in Bucharest, Sector 3, 51, Bd. Theodor Pallady, the Computing Center Building, 1st Floor, registered with the Trade Register under no. J40/3412/2010, tax registration number RO26728203.

With this service, Oti Shop customers can return free of charge within 14 calendar days the products purchased on the otishop.eu website, as per the Return Terms and Conditions provided by this Regulation.

This service does not affect the right of withdrawal provided for by Government Emergency Ordinance 34/2014 on consumer rights under contracts concluded with professionals, for remote contracts.

Customers who cancel their purchase, requesting to return a product, will comply with the rules of this Regulation, which they will accept in full.

The clients of otishop.eu are the direct beneficiaries of this free service.

They can be individuals or legal entities that have purchased products on otishop.eu.

How can you return the products purchased on otishop.eu?

Products purchased on otishop.eu can be returned within 14 calendar days:

  • by filling in the Return Form displayed on the website under the Shopping Information section accessible from the User account of the website https://otishop.eu/account or
  • unequivocal statement by which the buyer expresses his/ her decision to withdraw from the contract, the receipt of which will be confirmed (by email).

The period of 14 calendar days is calculated from the date of delivery of the product purchased on otishop.eu; in the case of an order containing several products, the period of 14 calendar days is calculated from the date of delivery of the last product in the order.

The buyer has the right to withdraw from the sales contract without having to justify hi/ her decision and without incurring any other costs.
In accordance with Directive 2011/83/EU, point (47) of the presentation: in order to determine the nature, characteristics and operation of the goods, the consumer should handle and inspect them in the same way as he / she would be allowed to do in a store.

You are responsible for any possible decrease in the value of the products, if following verification of the conformity, properties and functionality of the products it becomes clear that this devaluation has been caused by improper handling by you.

Conditions relating to the returned product

It is recommended that the returned product is in the same condition in which it was purchased or delivered:
● It has all components and accessories;
● The product must be returned safely, as far as possible in its original packaging, to avoid damage during handling and/or shipping.

Products not accepted for return

● Products showing physical changes, bumps, chipping, scratches, mechanical or electrical shocks. Products showing physical changes, bumps, chipping, scratches, shocks, traces of excessive use and/or unauthorized interventions, etc. are not accepted for return.
● If more than one product of the same model has been purchased, a return is accepted only if one single piece has been unsealed or unpacked;
● If a product included in a promotional package is returned, the difference between the base price and the promotional price of the returned product will be refunded.

The right to withdraw

The customer informs Oti General Trading S.R.L. of his/her decision to withdraw from the contract by filling in the Return Form available on the otishop.eu website.

For the products for which the return request was made through the Return Form on the website, within maximum 1 hour from the submission of the notification, the buyer will receive by e-mail details on his/ her submitted request. Any communication with the customer will be made in writing using the email address used to place the original order. The amount of the return will be paid by bank transfer.

Oti General Trading S.R.L. will issue a return invoice for the value resulted following the verification and will reimburse the customer for the respective amount of money, including the initial costs of delivery, if they were incurred by the buyer.

The return amount in the return tax invoice will be refunded to the customer via the same payment method. If the payment for the order was made using a debit card, the refund will be made by the same payment method no later than 3 days from the date on which Oti General Trading S.R.L. takes possession of the returned product, but no more than 14 calendar days from the moment Oti General Trading S.R.L. is informed of the consumer's decision to withdraw from the contract.

How long will it take to get your refund?

The refund will be made no later than 3 days from the date on which Oti General Trading S.R.L. takes possession of the returned product, but no more than 14 calendar days from the moment Oti General Trading S.R.L. is informed of the consumer's decision to withdraw from the contract.

The day on which the consumer exercises his/her right of withdrawal from the contract will not be taken into account when calculating this period, and if the last day of such period is a non-working day, Oti General Trading S.R.L. will extend the period accordingly.

Processing of personal data for the purposes of the return

If there are no non-conformities and the products meet all the return conditions mentioned above, the employees of Oti General Trading S.R.L. shall proceed to the preparation of the applicable financial and accounting documents, in accordance with the legal provisions (return/advance invoice, compensation provision, payment provision, receipt). The data necessary for the preparation of the above-mentioned documents refer to: surname, first name, domicile, series and no. of Identity Card, bank account, as the case may be. We will use the personal data for the purposes of the financial-accounting documents, according to the legal provisions in force. If you do not wish to provide this data, the return of the products is not possible, even if it falls within the return conditions presented above, as this way we would not be able to comply with the tax legislation.

Special costs and fees for cancelling the purchase: all costs are borne by Oti General Trading S.R.L.
Oti General Trading S.R.L. may refuse to cooperate with consumers who have abused their right to withdraw from a purchase. They would be notified prior to the imposition of restrictions on the sale of products or services.

 

Product guarantee

Oti Group is proud to offer a lifetime guarantee on Oti cast iron cookware from the date of purchase, for the lifetime of the original owner, whether a self purchase or received as a gift.

This lifetime guarantee covers defects in manufacturing and/or materials when the product is used in normal, household conditions and in accordance with the care and use instructions provided by the manufacturer.

This guarantee does not cover normal wear and tear, commercial use, or improper use and care of the product.

To make a guarantee claim, please provide the following with your Oti cast iron cookware: your name, address, the nature of the complaint, and the name of the retailer from whom the product was purchased (physical store or online store). Return the product along with the proof of purchase receipt and your contact details.

Defective cookware will be replaced at no charge with a similar product or one of equivalent value if the original product is no longer available.

*This lifetime guarantee does not affect your statutory rights. The lifetime guarantee does not apply to enamelled and non-stick coated cookware.

 

Promotions & Contests

OTI GENERAL TRADING SRL establishes the regulations of the promotions and contests it organizes. These regulations are brought to the attention of potential participants only on otishop.eu. Only orders that comply with the rules displayed on the website benefit from these promotions. Promotions also apply only to orders that are registered by the company within the time period specified in the regulation and during which the promotion is valid and only while stocks last. We do not guarantee the stock availability of the products for the promotion and we may discontinue or cancel it at any time without any prior notice.

User comments on the otishop.eu website

Users accessing the otishop.eu website can comment and review the products we offer, which may be published on the website after prior approval. OTI GENERAL TRADING S.R.L. reserves the right, but not the obligation, not to publish on the website comments with illegal, obscene, threatening, defamatory content, which in any way disturbs the privacy of others, violates intellectual property rights, contains viruses, texts representing mass emails or any other form of spam.

OTI GENERAL TRADING S.R.L. shall not be responsible nor shall it be liable for any compensation for any damages caused by such comments or electronic communications, which are offered under the same limitation of liability as the rest of the content on the website, according to the articles in this document. In the case of sending information other than that related to the process of buying/selling products, the user is deemed to give OTI GENERAL TRADING S.R.L. the non-exclusive, unlimited, free, irrevocable and re-transferable right to use, reproduce, modify, adapt, publish, translate, as well as the right to distribute it through any media anywhere.

The User warrants that he/she has all rights on the content he/she transmits by any means for publication on the website or not, so that by using this content he/she does not cause damage to any other person.

We use the personal data contained in the CVs we receive to assess the applicants' qualifications for a position with OTI GENERAL TRADING SRL, including in connection with our internship program. When processing we rely on the conclusion and execution of the agreement.
The categories of data processed in the context of our relationship with you are your name, email address, telephone, fax, address, personal data included in CVs, details of education and training, professional qualifications, as well as other personal data you may provide directly.

7. If you are a visitor to our premises:
We use your personal data to ensure the security of our premises, property and personnel. In this case, the processing of our data is based on the legitimate interest of the online store, namely the protection of these premises, assets and personnel.
